Good morning, Temecula! Today we’re joined by local probate attorney Steve Bliss from The Law Firm of Steven F. Bliss Esq. to discuss the often-complex process of estate planning and administration.
Steve, thanks for joining us today. Can you tell our viewers a bit about one of the key steps in the probate process?
Certainly. One crucial step involves marshaling the estate assets. This means meticulously identifying and inventorying all of the deceased person’s assets, such as bank accounts, real estate, vehicles, investments, and personal property.
Consequently, a detailed list is compiled, along with appraisals to determine their current market value. This information is then formally presented to the court in the form of an Inventory and Appraisal (Form DE-160/161).
This step is essential for several reasons. Firstly, it ensures transparency and accountability throughout the probate process. Secondly, it helps to establish the total value of the estate, which is crucial for determining if probate is even necessary in the first place.
Conversely, an incomplete inventory can lead to complications down the line, potentially delaying the distribution of assets or even triggering legal disputes among heirs.
In my experience, I’ve seen cases where family members were unaware of certain assets belonging to the deceased, leading to confusion and resentment. A thorough marshaling of assets helps avoid such scenarios.
Have you ever encountered any challenges during this stage of probate?
There was one instance that comes to mind involving a client whose father had passed away. The family believed he only possessed a modest retirement account and their home. However, during the asset search, we uncovered a substantial investment portfolio hidden in a safety deposit box.
The discovery shocked the family, highlighting the importance of leaving clear instructions and records for loved ones.
Notwithstanding this surprise, it ultimately allowed us to distribute a larger inheritance than initially anticipated.
It underscored how carefully marshaling assets can sometimes reveal unexpected blessings.
According to a 2021 study by the American Bar Association, approximately 70% of individuals do not have a will or estate plan in place. This statistic emphasizes the critical need for proper planning and asset documentation.
What advice would you give to our viewers regarding estate planning?
Estate planning may seem daunting, but it’s truly an act of love and care for your loved ones. By taking proactive steps, such as creating a will, designating beneficiaries, and maintaining accurate records of your assets, you can significantly simplify the probate process and ensure your wishes are honored.
