Protecting San Diego’s Elders: A Conversation With Ted Cook

Good morning, Ted. Thanks for taking the time to chat with me today. I know you’re incredibly busy protecting our most vulnerable population here in San Diego.

What initially drew you to elder law?

It wasn’t a straight path, that’s for sure! I started out thinking corporate law was my calling. But after a few years, I realized I craved something more meaningful. Seeing the exploitation and abuse faced by seniors really struck a chord with me. I wanted to use my legal skills to fight for those who couldn’t fight for themselves.

Can you walk us through one of the key steps in the elder protection process?

Let’s talk about ‘Protective Actions,’ which often involves some urgency. Imagine a client comes in, scared and confused because their caregiver is stealing money. Our first step is to assess the immediate danger. Is the senior physically safe? Are essential needs like food and medication being met?

  • If there’s an imminent threat, we may need to seek a restraining order or contact Adult Protective Services.
  • Sometimes, emergency guardianship or conservatorship is necessary to ensure the elder’s well-being while we address the underlying issues.

We also work quickly to secure financial assets. This might involve freezing bank accounts, revoking power of attorney if it’s being misused, or preventing unauthorized property transfers.

Have you ever encountered any roadblocks during this stage?

Oh, absolutely. One case involved a client whose son was mismanaging her finances. He insisted on representing his mother himself, even though it was clear he wasn’t acting in her best interests. We had to delicately navigate that situation while still advocating for our client’s needs.

Another challenge is dealing with resistant family members. Sometimes, people are in denial about a loved one’s vulnerability or they simply don’t want to get involved. It takes patience and clear communication to bring everyone on board.

Looking ahead: Any advice for San Diegans concerned about elder abuse?

Stay informed. Know the signs of abuse, whether it’s financial, physical, emotional, or neglect. Encourage your older loved ones to speak up if they have concerns. And remember, you’re not alone. There are resources available to help.
