Determining If Probate Is Necessary
Today we’re speaking with Steve Bliss, a highly respected probate attorney serving the Wildomar community. Mr. Bliss, can you walk us through one of the initial steps in the estate planning process?
Certainly. One of the first crucial steps is determining whether probate is even necessary. This involves assessing the value of the deceased person’s estate and identifying any assets that might bypass probate altogether.
In California, if an estate’s gross value exceeds $184,500, probate is typically required. Conversely, assets held in a trust, jointly owned property with rights of survivorship, or designated beneficiary accounts like life insurance policies and retirement accounts are generally not subject to probate.
Consequently, understanding the composition of an individual’s assets is paramount. For example, I recently worked with a family where the deceased had a substantial sum in a brokerage account named jointly with their spouse. This meant the funds directly passed to the surviving spouse, avoiding the complexities and costs associated with probate.
Notwithstanding these exceptions, it’s important to remember that even smaller estates may benefit from probate if there are complex family dynamics or disputes regarding asset distribution. Ultimately, a thorough legal review of an individual’s circumstances is essential to make an informed decision.
Navigating the Probate Process
Steve, have you encountered any common challenges or pitfalls during this initial assessment stage?
It’s not uncommon for individuals to underestimate the value of their assets. I recall a case where a client thought their estate was well below the probate threshold. Upon closer examination, however, we discovered that certain real estate holdings had significantly appreciated in value, pushing the total estate above the limit.
This highlights the importance of working with an experienced probate attorney who can accurately evaluate asset values and guide clients through the process. Remember, according to the California Courts website, over 90% of probate cases are handled without significant disputes. This underscores the value of proper planning and legal guidance in minimizing potential complications.
