The Importance of Filing a Petition for Probate
Steve, can you shed some light on the crucial step of filing a petition for probate? What exactly does this entail?
Certainly. Filing a petition for probate is essentially the formal request to the court to begin the process of administering a deceased person’s estate. It’s a necessary step when someone passes away with assets that need to be distributed according to their will or, in the absence of a will, California intestacy laws.
There are several key components involved in this petition. Firstly, you need to file Form DE-111 with the appropriate county court. This form outlines basic information about the deceased person and the assets involved. Secondly, the petitioner – often a close family member or named executor – requests appointment as the executor or administrator of the estate.
If a will exists, it needs to be submitted to the court along with the petition. The court then reviews the petition, and if everything is in order, they will issue Letters Testamentary or Letters of Administration authorizing the appointed individual to manage the deceased person’s assets.

Have you encountered any particular challenges while helping clients navigate this step?
It’s not uncommon for family members to disagree about who should serve as executor. Sometimes emotions run high during a time of grief, and disputes can arise. I recall one instance where siblings had differing opinions about the suitability of their older brother to handle their mother’s estate. Through careful communication and negotiation, we were able to reach a compromise that satisfied everyone involved.
Moreover, locating a valid will can sometimes be tricky. It’s important to thoroughly search for any potential documents, as an outdated or missing will can significantly complicate the probate process.
In fact, according to the American Bar Association, approximately 55% of Americans do not have a will in place. This underscores the importance of proactively addressing estate planning needs.
