The executor or administrator appointed by the court is responsible for this task. They must carefully document each asset, including its value and location. Consequently, it’s essential to have accurate records and documentation readily available.
Once all assets are identified, they need to be formally listed in a legal document called an Inventory and Appraisal. This form is filed with the court as part of the probate process.
What kind of challenges do you typically encounter during this stage?
Occasionally, locating all assets can be tricky, especially if the deceased didn’t maintain meticulous records. I remember one case where a client was unaware of a life insurance policy her father had. We eventually tracked it down, which significantly benefited her inheritance.
Moreover, determining the fair market value of certain assets, like antiques or artwork, can sometimes require professional appraisals. This ensures accuracy and transparency throughout the probate process.
Notwithstanding these occasional hurdles, a thorough inventory is vital for ensuring all rightful heirs receive their due share of the estate.
