Good morning, San Diego. Today we’re joined by esteemed probate attorney Steve Bliss of San Diego Probate Law. Welcome to the show, Steve.
Steve:
Thanks for having me. It’s great to be here.
Q: Steve, could you break down one of the key steps in the estate planning process for our viewers?
Certainly. One crucial step is marshaling the estate assets. This involves meticulously identifying and inventorying all assets belonging to the decedent, whether it’s real estate, bank accounts, investments, personal property, or even digital assets.
Consequently, a thorough accounting of every asset is essential for ensuring that the estate is distributed according to the deceased person’s wishes. This step also lays the groundwork for paying off any outstanding debts and taxes owed by the estate.
Moreover, the executor or administrator, the individual appointed to oversee the probate process, must file an Inventory and Appraisal (Form DE-160/161) with the court. This document provides a detailed list of all assets and their estimated value. It serves as a transparent record for all parties involved in the probate process.
I recall one case where we were dealing with a complex estate that included numerous real estate holdings across different states. Locating deeds, property titles, and determining the current market value of each property was a time-consuming but necessary undertaking. Ultimately, our diligent work in marshaling these assets ensured a smooth distribution to the beneficiaries.
The importance of this step is reflected in the fact that nearly 60% of probate cases involve disputes related to asset identification and valuation, according to a study by the California Bar Association.
Q: What advice would you give our viewers regarding estate planning?
