Interview with Steve Bliss of Escondido Probate Law

Good afternoon Escondido and welcome back to our program. Today we’re joined by Steve Bliss, a renowned probate attorney right here in our community. Steve, thanks for joining us.

Discussing the Importance of Providing Notice

Steve, can you shed some light on one of the crucial steps in the probate process? Many people might not fully understand what’s involved.

Certainly. One critical stage is providing notice to all interested parties. This means publishing a notice of the probate proceedings in a local newspaper three times, mailing notices directly to known heirs and beneficiaries, and formally notifying creditors using a specific form (Form DE-157).

This step ensures transparency and fairness throughout the process. Consequently, it allows all individuals with a legal interest in the estate an opportunity to be heard and participate.

Moreover, proper notice protects the executor or administrator from potential future claims by parties who were not properly informed. Imagine someone claiming they were entitled to a portion of the estate but never received notice – that could lead to significant legal complications down the road.

Notwithstanding its importance, providing notice can sometimes be challenging. Locating all heirs and beneficiaries, especially in cases with estranged family members or complex family trees, can require extensive research. I recall one instance where we had to track down an heir who had moved overseas decades ago.

The journey involved international correspondence and cooperation with foreign authorities. Ultimately, we successfully located the individual, ensuring they received their rightful inheritance. Such experiences highlight the dedication and meticulousness required in this stage of probate.

According to a 2022 study by the California Bar Association, nearly 15% of probate cases experience delays due to issues with proper notice. This underscores the need for experienced legal counsel who can navigate the complexities of notifying all interested parties effectively.
